Transfer

The
2006-2008 Collective Negotiations Contract contains a number of
changes the Article 12 - Transfer. Among the changes are:
Right
of First Refusal has been eliminated from the contract.
"Priority Consideration" as defined in Section 12.1.9
will apply to
unit members who are excessed from a site because of a staff
reduction and to unit members at schools that are closed.
The
contract establishes new rules for the staffing of schools with
Academic Performance Index ratings of one, two or three. (Section
12.1.12)
The
number of post and bids under Section 12.2.1 is reduced to two
per year. The contract specifies that the May post "shall
be scheduled to allow the inclusion of positions that become vacant
as a result of the February post." The section, also, sets
a thirty-calendar limit for sites to select from among qualified
bidders. The time limit starts when "site administrators
are provided with the names of eligible bidders by Human Resource
Services
Division, Certificated."
Probationary
One employees who were hired into a special education
position may only bid on positions within the special education
program. Probationary Two employees may bid on any positions but
must qualify for permanent status in order to move into a general
education position. (Section 12.2.9)
Section
12.7.1 - Administrative Transfer has been changed by adding a
reference to the Pre-Arbitration Settlement Agreement dated September
27, 2005. The complete Pre-Arbitration Settlement Agreement will
be in a new appendix. The change significantly limits the grounds
upon which the district can seek to administratively transfer
a unit member
There
are other changes that can be found by reviewing Article 12.
