Dear SDEA Bargaining Unit Member,
Your union stands with you. By now you and your SDEA AR should be working through the grievance process as we all work together to defend your job and your future with SDUSD. We will keep working until every job is restored! You are the most critical advocate in your own defense against the layoffs--and we need your help.
First, we are planning a massive rally during the next School Board meeting at the Education Center (4100 Normal Street) on Tuesday, April 22 at 5:00 pm. It’s important to remember that you were laid off by four SDUSD Trustees who voted to approve the RIF on March 11 (Acle, deBeck, Lee and Nakamura). If they are going to change their minds by May 15th, they need to hear from you NOW. Please plan to attend and bring your family, friends, school parents, and co-workers. The Board must see the people whose lives they’re disrupting: yours!
Next, please plan to attend one of our three upcoming informational meetings for Probationary employees who received RIF notices:
- Thursday, April 17 at 4:30 pm
- Monday, April 21 at 4:30 pm
- or Thursday, April 24 at 4:30 pm
All three meetings will be held at SDEA (10393 San Diego Mission Road, Suite 100; San Diego, 92108).
Finally, please complete and return to SDEA the enclosed “Probationary RIF Data Form.” This form gives us much needed information that will guide our defense of your job as we move to Step 3 grievances and possible arbitration hearings. You can drop off the form at our office or bring it tone of the informational meetings noted above.

Dear SDEA Unit Member,
Your union stands with you. As the SDUSD School Board proceeds with disseminating “Reduction in Force” (RIF) or layoff notices to our fellow SDEA members, SDEA staff, SDEA/CTA attorneys, and your fellow SDEA members are working hard to protect all our members. We recognize how stressful this situation is for everyone and we want to assure you that we will all do our best to protect your job.
This is a precautionary letter because our records indicate that you may be receiving a RIF notice from the District. This letter is NOT a notice of layoff; it is part of SDEA’s best effort to ensure that all members are aware of their rights in the event that you do receive a layoff notice from SDUSD.
If you do receive a RIF notice, it is critical that you read and follow the advice below in the upcoming days and weeks. Please note that the RIF notices sent by the District are necessarily worded in a stern legal fashion, so be prepared.
- Your rights in a layoff are covered by Articles 19 and 15 of the Collective Negotiations Contract between the District and SDEA. The layoff timeline and process for probationary employees is different than the timeline and process for permanent teachers. You can read the pertinent contract sections on the SDEA web site: (http://www.sdea.net/contract.html).
- If you are to receive notice of layoff it should arrive no later than April 15, 2008. However, we believe the District will send out notices to probationary employees by March 15, 2008. Notice is complete when you are personally served or when the notice is deposited in the United States mail, certified, return receipt requested, postage prepaid, addressed to you at the last known address on file with the District. Please make sure the District has your current address.
- If you believe you have been laid off improperly, you should contact your Association Representative (AR) at your site to file a grievance. A formal grievance must be filed within fifteen work days from the date you learned of the facts that give rise to your grievance. All site ARs will be trained on how to file grievances on March 12, 2008. Copies of their materials will also be available on the SDEA web site on March 12, 2008.
- What you can do right now: gather any and all documents you may have relative to your employment with SDUSD, especially copies of signed contracts.
