Visiting Teacher Wage Claim Grievance Settlement


Visiting Teachers,

Last Spring, SDEA filed a class action grievance on behalf of all Visiting Teachers within San Diego Unified School District once it became known that the District was incorrectly calculating pay.

Per Appendix D of the SDEA-SDUSD Collective Bargaining Agreement, Visiting Teachers should be paid a daily rate for each assignment.  The District had been calculating a separate hourly rate which is not allowed by the contract.  As a result, the District recently agreed to provide back pay to affected visiting teachers.

Despite the District’s agreement that the contract was violated and that visiting teachers are due back pay, there is a provision in the contract which limits the time frame for back pay through a grievance.  The District will automatically provide back pay for any date after February 1, 2016 in which you worked and received less than the full daily rate.  A list of affected visiting teachers, along with the amount due, can be found here.

California law allows public employees to submit wage claims for back pay for a period of up to one calendar year.  Individual employees must submit wage claims on their own behalf.  SDEA is not able to file this claim.
